For the purposes of these Terms of Service, the following definitions shall apply, and these terms shall have the meanings ascribed to them herein unless the context clearly indicates otherwise. It is essential to understand these definitions as they form the foundation of the agreement between you and GeeGee, ensuring clarity in all aspects of service usage, responsibilities, and rights.
These definitions are intended to provide clarity and avoid ambiguity in the interpretation of these Terms. If any term is unclear, please contact our support team for further explanation before proceeding with use of the Service. By continuing, you acknowledge understanding of these key terms and their implications on your use of GeeGee.
- Company: Refers to GeeGee Mobility Inc., the entity operating GeeGee, a Canadian-based ride-sharing platform dedicated to providing innovative, safe, and inclusive transportation solutions tailored to the unique needs of users in urban centers and remote areas. The Company is registered in Ontario and complies with all applicable Canadian laws, including but not limited to privacy regulations under PIPEDA and language requirements in Quebec.
- Service: Encompasses the GeeGee mobile applications (available on iOS and Android), website, and all associated features, functionalities, and content provided by the Company. This includes, but is not limited to, ride booking, pre-order systems allowing advance reservations up to 60 days with discounts, real-time tracking, payment processing, safety tools such as emergency reporting and location sharing, multilingual support for over 1,000 languages, pet-friendly and gear-accommodation options, group ride suggestions, weather-adjusted ETAs, open data sharing initiatives, and any future enhancements or expansions as described in our development roadmap.
- User: Any individual or entity who accesses or uses the Service in any capacity, whether as a rider requesting transportation, a driver providing services, or otherwise interacting with the platform. Users must be at least 18 years of age or have legal guardian consent, and they agree to abide by all terms, including account verification processes, code of conduct, and safety protocols. Users include both registered account holders and guests, though certain features may require full registration.
- Rider: A User who requests or books rides through the Service. Riders benefit from features like pre-order discounts (up to 15% for advance bookings), fare estimates with transparent breakdowns, real-time tracking with live sharing options, secure payments with automatic refunds for eligible cases (such as price drops or cancellations), ride history with detailed receipts, ratings and reviews system to maintain quality, barcode scanning for quick pickups, pet-friendly matching with additional fees, multilingual support for voice and text (offline capable), extra space filters for sports gear, vulnerable care options with ID-based hand-offs and 5% discounts, group ride suggestions for 30% savings, weather-smart ETAs, emergency tools, and referral programs offering $15 credits.
- Driver: A User who provides transportation services through the Service. Drivers must undergo verification including license, background, and vehicle checks. They receive 65-70% fare shares (higher 67% for female drivers to promote inclusion), 7% maintenance fund deductions for vehicle upkeep, instant partial payouts for pre-orders, cancellation compensation, after-ride earnings summaries, secure document storage, breakdown assistance with replacements, opt-in for pet/gear rides, and performance incentives based on acceptance rates.
- Pre-Order: A unique booking system allowing rides to be scheduled up to 60 days in advance, with fixed prices, surge protection, and discounts based on lead time (up to 15%). Includes shareable links for promotion, payment options (upfront for max discount or later), auto-refunds if prices drop, and limits like maximum 400km distance to prevent abuse.
- Content: All text, images, videos, data, and other materials on the Service, including user-generated reviews, ratings, and shared data. Content must comply with our code of conduct, and intellectual property rights are retained by the Company or respective owners.
- Open Data: Anonymized, aggregated ride summaries shared monthly publicly in compliance with government rules, excluding personal information, to promote transparency, research, and community planning.
- PIPEDA: The Personal Information Protection and Electronic Documents Act, Canada's federal privacy law for private-sector organizations, which GeeGee fully complies with in handling user data.
- Additional Terms: Specific terms for drivers, riders, pre-orders, safety features, and other functionalities as detailed in subsequent sections. These are integral to the overall agreement and must be read in conjunction with the general terms.
2. Acceptance of Terms & Conditions
By accessing, downloading, installing, or using the GeeGee Service in any manner, whether through our mobile applications, website, or any associated platforms, you signify your assent to these Terms of Service, our Privacy Policy, and any other applicable policies or guidelines that may be posted or linked within the Service from time to time. This acceptance forms a legally binding agreement between you and GeeGee Mobility Inc. If you are using the Service on behalf of an entity or organization, you represent that you have the authority to bind that entity to these Terms.
Your continued use of the Service following any updates or modifications to these Terms constitutes your acceptance of those changes. We recommend reviewing the Terms periodically, as they may be revised to reflect changes in our practices, legal requirements, or Service features. Notifications of material changes will be provided via in-app messages, email, or website postings. If you do not agree to any part of these Terms or future modifications, your sole remedy is to discontinue use of the Service immediately, which may include deleting your account and uninstalling the app.
These Terms incorporate by reference our Privacy Policy, which details how we collect, use, and protect your personal information, including location data, payment details, and usage patterns. Additionally, specific features like pre-order rides, driver verification, safety tools (e.g., emergency reporting, location sharing), multilingual support, pet-friendly matching, gear space filters, vulnerable rider protections, group ride suggestions, weather-adjusted ETAs, open data sharing, and referral programs have supplementary terms outlined in relevant sections. Violation of any incorporated policy may result in account suspension or termination.
In the event of a conflict between these Terms and any other agreement you may have with us (e.g., driver-specific terms), the more specific agreement shall prevail. These Terms apply to all users, including riders, drivers, and visitors, regardless of location within Canada or elsewhere. By agreeing, you confirm that you are of legal age (18+) or have parental consent, and that your use complies with all applicable laws, including transportation regulations in your jurisdiction.
We reserve the right to refuse service to anyone for any reason at any time, particularly in cases of suspected fraud, abuse, or violation of terms. Your acceptance also includes consent to electronic communications from GeeGee, such as updates, promotional offers, and service notifications, which you can opt out of at any time through account settings.
3. Eligibility & Account Requirements
To be eligible to use the GeeGee Service, you must meet certain criteria designed to ensure a safe and compliant community. Firstly, you must be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher. If you are under 18, you may only use the Service with the express consent and supervision of a parent or legal guardian, who must agree to these Terms on your behalf. We reserve the right to request proof of age or guardian consent at any time, and failure to provide such proof may result in account suspension or termination.
For account creation, you are required to provide accurate, current, and complete information, including but not limited to your full legal name, valid email address, phone number, and any other details requested during registration. Identity verification may be required, such as through government-issued ID or other methods, to prevent fraud and ensure compliance with safety standards. Riders and drivers must maintain only one account; multiple accounts are prohibited and may lead to permanent bans.
Drivers have additional eligibility requirements: You must hold a valid driver's license, pass background checks (including criminal and driving records), provide vehicle registration and insurance proof, and meet any local regulatory requirements for ride-sharing services. Vehicles must be in good condition, with tags for features like pet-friendly setups or extra gear space if opted in. Failure to maintain eligibility (e.g., license expiration) will result in automatic account pauses until resolved.
Riders must ensure their use complies with local laws, including age restrictions for unaccompanied minors. Vulnerable riders (e.g., seniors, those with disabilities) may qualify for special features like discounts or secure hand-offs, but must provide necessary information for verification. All users agree not to use the Service for illegal purposes, and we may monitor activity to enforce this.
Account security is your responsibility: Use strong passwords, do not share credentials, and notify us immediately of any unauthorized access. GeeGee is not liable for losses due to compromised accounts. We may terminate accounts for inactivity (e.g., 12 months) or violations, with notice where required by law. By creating an account, you consent to electronic communications and data collection as per our Privacy Policy.
4. User Responsibilities & Code of Conduct
As a user of GeeGee, you have important responsibilities to ensure a positive, safe, and respectful experience for everyone. You agree to use the Service only for lawful purposes and in compliance with all applicable local, provincial, federal, and international laws, regulations, and these Terms. This includes not using the Service for any illegal activities, such as fraud, harassment, or transportation of prohibited items.
All information provided during account creation, ride booking, or interactions must be accurate and up-to-date. Misrepresentation, including fake accounts or spoofed locations, is strictly prohibited and may result in immediate termination. Users must treat others with respect: No discrimination, harassment, or abusive behavior toward drivers, riders, or support staff. Report any incidents promptly through in-app tools.
Riders are responsible for their conduct during rides: Arrive on time, follow driver instructions, and maintain cleanliness. For features like pet-friendly or gear space, provide accurate details to avoid mismatches. Drivers must maintain safe vehicles, adhere to traffic laws, and provide courteous service. Both parties agree not to solicit off-platform rides or payments to circumvent fees.
Code of Conduct: Be polite, no smoking or eating without permission, secure belongings, and respect privacy (no unauthorized recording). Violations may lead to warnings, suspensions, or bans. We encourage positive ratings and feedback to improve the community. Users indemnify GeeGee against claims arising from their misuse of the Service.
Additional responsibilities include not interfering with the Service (e.g., hacking, spamming), respecting intellectual property, and complying with data privacy rules. For pre-orders, honor bookings or face fees. We monitor for abuse and may share information with authorities if needed. By using GeeGee, you commit to upholding these standards for a better ride-sharing ecosystem.
5. Payment, Pricing & Fares
Payments for rides are handled securely through integrated gateways like Stripe or Moneris. Fares are calculated based on base rate, distance, time, demand, and extras (e.g., pet fees, gear space). Estimates are provided pre-confirmation, with transparency on breakdowns. Dynamic pricing may apply during high demand, but pre-orders lock rates to avoid surges.
Riders authorize charges upon ride completion or pre-order booking. Multiple payment methods supported, with saved options for convenience. Tips are optional and go fully to drivers. For pre-orders, upfront payment secures discounts; partial refunds for cancellations (>24h: 100%, <24h: 90%, after match: fair fee). Auto-refunds if day-of prices drop below pre-paid amount.
Drivers receive 65-70% of fares (67% for females), minus 7% maintenance fund. Payouts weekly or instant for fees. Cancellation fees compensate drivers for time/fuel. Disputes over charges must be submitted within 7 days; we investigate and resolve fairly. No liability for payment processor errors.
All transactions in CAD, with taxes applied per jurisdiction. Users responsible for any bank fees. We may offer promotions, discounts (e.g., 5% for elders), or referrals ($15 credit), subject to terms. Abuse of promotions (e.g., multiple accounts) results in disqualification and potential bans.
In case of fraud or disputes, we cooperate with authorities. By using the Service, you consent to electronic billing and agree that no signature is required for charges. Refunds processed within 5-10 business days to original method.
6. Cancellation & Refund Policy
Cancellations are allowed but subject to fees to ensure fairness. For standard rides: Free if before driver acceptance; small fair fee after matching to compensate driver time/fuel. For pre-orders: >24h before: 100% refund; <24h: 90% refund (10% to driver); after start: no refund unless exceptional circumstances.
Drivers can cancel for safety or vehicle issues, with no penalty if reported promptly. Repeated cancellations may affect ratings or shares. Auto-refunds for rider cancellations where eligible, processed to original payment method within 5-10 days. For price drops on pre-order day, difference refunded automatically.
No-shows: Riders charged full fare if not present; drivers must wait minimum time before canceling. Disputes reviewed case-by-case; evidence like location data considered. Refunds not guaranteed for user error but granted for Service faults (e.g., app glitches).
Policy aims to balance interests: Protect drivers from wasted time while allowing rider flexibility. Changes to policy notified via app/email. In force majeure events (e.g., severe weather), fees may be waived at our discretion.
All refunds subject to payment processor terms. We reserve right to deny refunds for abuse. Contact support for questions; responses within 48 hours.
7. Safety, Insurance & Liability
Safety is paramount at GeeGee. We implement features like real-time tracking, emergency reporting, location sharing, women-only options, and secure hand-offs for vulnerable riders. Drivers undergo background/license checks; vehicles inspected. However, we do not guarantee safety and are not liable for incidents during rides.
Users assume risks of transportation. Drivers must maintain insurance per local laws; we provide supplemental coverage for active rides (details in driver terms). Riders encouraged to have personal insurance. No liability for loss/damage to property, injury, or death arising from use.
Report safety issues immediately; we investigate and may suspend users. Fraud prevention includes GPS spoofing detection, fake account blocking. You release GeeGee from claims related to driver/rider actions, agreeing to arbitrate disputes.
For breakdowns, auto-replacement at no extra cost. In emergencies, use in-app tools to contact authorities. We cooperate with law enforcement as required. By using, you acknowledge inherent risks and agree to hold us harmless.
Liability limited to direct damages, not exceeding fares paid in past 12 months. No consequential damages. This section survives termination.
8. Driver-Specific Terms
Drivers are independent contractors, not employees. You must meet eligibility: valid license, clean record, insured vehicle. Provide accurate info for verification; maintain standards or face suspension.
Earnings: 65-70% fare share (67% for females), 7% maintenance fund. Instant pre-order payouts. Accept rides promptly; high rates for incentives. Comply with laws, provide safe service.
No discrimination; follow code of conduct. Use app for all interactions; no off-platform deals. Report incidents; cooperate with investigations. We may share data with insurers/authorities.
Vehicle tags for pet/gear optional but encouraged. Breakdowns: Notify for replacement; use fund for repairs. Termination for violations; appeal process available.
You indemnify us against claims from your actions. This section supplements general terms.
9. Rider-Specific Terms
As a rider, you agree to provide accurate pickup/drop-off info, be ready on time, and treat drivers respectfully. For pre-orders, honor bookings or face fees. Use features like pet details accurately to avoid mismatches.
Safety: Verify driver/vehicle before entering. Use emergency tools if needed. No illegal items or activities. Vulnerable features (e.g., hand-offs) require accurate info for proper use.
Payments: Authorize charges; disputes within 7 days. Ratings: Provide honest feedback. Referrals: Limited to prevent abuse. We may limit service for repeated issues.
You release us from liability for driver actions. This section supplements general terms.
For group rides, share costs fairly; follow suggestions for savings.
10. Intellectual Property & User Content
All Service content, including logos, designs, text, and features (e.g., pre-order system, AI matching), is owned by GeeGee or licensed. You receive limited, non-transferable license to use for personal purposes.
Do not reproduce, modify, or distribute without permission. User Content (e.g., reviews, feedback) grants us perpetual, royalty-free license to use for Service improvement/marketing.
Report IP infringements; we respond per DMCA-equivalent processes. No endorsement of User Content; we may remove offensive material.
Trademarks like "GeeGee" are protected; no unauthorized use. Violations may lead to legal action.
Open data shared is anonymized and for public good, not including proprietary info.
11. Dispute Resolution & Arbitration
Disputes arising from these Terms or Service use shall be resolved through binding arbitration in Toronto, Ontario, under Canadian Arbitration Association rules. No class actions; individual basis only.
Before arbitration, attempt informal resolution via support. If unsuccessful after 30 days, proceed to arbitration. Arbitrator's decision final and enforceable.
For small claims under $10,000, option for court. We cover reasonable arbitration fees for non-frivolous claims.
This provision survives termination. If unenforceable, disputes in Ontario courts.
You waive jury trial and class action rights.
12. Termination, Suspension & Account Deletion
We may suspend or terminate your account for violations, fraud, or at our discretion, with or without notice. Upon termination, access ends; data may be deleted per privacy policy.
You can delete your account via settings; unpaid balances settled first. Termination doesn't relieve obligations like outstanding payments.
For inactivity (12 months), we may deactivate with notice. Appeals for wrongful termination via support.
Post-termination, you can't create new accounts without permission. We retain data as required by law.
This section survives termination of Terms.
13. Changes to Terms & Service
We reserve the right to modify these Terms or the Service at any time. Changes will be posted on the website/app with effective date. Material changes notified via email/in-app at least 30 days prior.
Continued use after changes constitutes acceptance. If you disagree, stop using the Service. We may discontinue features with notice.
Check Terms regularly. Prior versions available upon request.
Changes may reflect new features (e.g., subscriptions) or legal requirements.
Your feedback on changes is welcome via support.
14. Warranties, Disclaimers & Limitations
The Service is provided "as is" without warranties, express or implied, including fitness for purpose or non-infringement. We don't warrant uninterrupted access or error-free operation.
No liability for indirect, consequential, or punitive damages. Total liability limited to fares paid in past 12 months. Disclaimers apply to maximum extent permitted by law.
We don't warrant driver/rider conduct; users assume risks. For app downloads, no virus guarantees.
Third-party links/services not endorsed; use at own risk.
These limitations survive termination.
15. Governing Law, Jurisdiction & Legal Compliance
These Terms governed by Ontario, Canada laws, without conflict principles. Exclusive jurisdiction in Toronto courts for non-arbitrable matters.
You agree to comply with all laws, including export controls and anti-corruption. Service not available where prohibited.
For Quebec users, bilingual terms apply per law. PIPEDA governs data privacy nationwide.
If provision invalid, remainder enforceable. No waiver unless written.
Entire agreement; supersedes priors.
